Cheap vs. Inexpensive Patent Drawings

You can get patent drawings inexpensively, I'll tell you how in a minute.  But before you decide that cutting corners or "cheap" patent drawings are right for you, understand the long term costs and lost opportunities that often result from inferior patent drawings.

In utility patents:

  • Courts keep ruling "if it's not in the drawings, it's not in the patent".

  • If you file informal drawings, formalized drawings can not include new matter.

  • Your claims can be changed to read on the drawings, if the drawings enable what you want to claim.

In design patents:

  • The drawings are the claims meaning they define what is covered by your patent.

  • It is virtually impossible to "formalize" design patents filed with informal drawings.

  • In some cases it is necessary to re-file a new design patent with a new filing date and new filing fees.

In summary, cheap patent drawings can cost much more than they save

How to get GREAT, Inexpensive Patent Drawings

If you have a 3D CAD model of your invention use File, SaveAs, STEP to create a 3D model your illustrator can open, create the necessary views and add item numbers or shading as necessary for the type of patent you are filing. 

If you have 2D CAD files or blueprints use File, SaveAs, DWG.  Your illustrator will only be able to create the views you save as DWG files.  More info about 2D and 3D files.

If you have photos of a prototype, take at least seven photos of your invention; front, back, left, right, top, bottom and at least one perspective view.  Use your camera's zoom to reduce the fish eye effect and be sure your orthographic views are as "square" or as "straight on" as possible.  This is especially important for design patents.  Your illustrator will trace the photos and add shading or item numbers as necessary.  More info about photographs.

If you have sketches of your invention make them as clear and complete as possible.  More guessing and more revisions equal more time.  More time equals more money.
